			<content:encoded><![CDATA[<p class="MsoNormal" style="margin: 0in 0in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;" align="left">Information management is critically important to all of us - as employees and consumers. For that reason, the Identity Theft Resource Center has been tracking security breaches for the past three years, looking for patterns, new trends and any information that may help us better protect data and assist companies in their activities.</p>
<p>2008 Figures</p>
<p>The ITRC Breach Report total has reached an all-time high. Between January 1st and June 27th, the total number of data breaches recorded by the ITRC is 342, more than 69% greater than the same time period in 2007. The actual number of breaches is likely even higher, due to underreporting and the fact that some of the breaches reported as a single event actually affected multiple businesses.</p>
<p>The ITRC Breach Report sub-divides all breaches into five categories. To date, the 2008 ITRC Breach Stats Report indicates the following: 17.0% government/military agencies, 21.3% from educational institutions, 36.8% from general businesses, 14.9% from health care facilities / companies, and 10% from banking / credit / financial services entities.</p>

<p>The Opinions of Chief Legal Officers on Issues of Importance</p>
<p>For the ninth year in a row, Altman Weil, Inc. has surveyed Chief Legal Officers (CLOs) in issues of importance in managing their corporate law departments. The purpose of these surveys is to:</p>
<p>1) Capture current thinking of Chief Legal Officers.<br />
2) Compare CLOs’ year?to?year answers and changes in thinking, including three?year trend data when available.<br />
3) Share the results of the tabulated surveys with the legal profession, enabling both corporate law departments and law firms to benefit from the surveys.</p>
<p>Participation</p>
<p>One hundred and twenty six Chief Legal Officers provided responses for the 2008 survey, conducted in May and June 2008. The survey responses were tabulated and analyzed, including a summary of the results in Section 2 and demographic data on survey participants in Section 3.</p>

<p>The Legal and Economic Implications of Electronic Discovery Options for Future Research</p>
<p>This paper reports on exploratory research to identify the most important legal and economic implications of electronic discovery and to develop a research plan in this subject area for the RAND Institute for Civil Justice. To achieve these objectives, we reviewed the current state of electronic discovery (e-discovery) law and practices, including the main features of the new federal rules, interviewed several experts in electronic discovery issues as well as in-house counsel for a number of very large corporations, conducted an initial modeling effort to simulate the range of plausible effects of e-discovery on case outcomes, and analyzed the implications of our results for future research.</p>
<p>This paper should be of interest to the research community and to those who are potential funders of policy analysis in this area.</p>

<p>Discovery is the process of identifying, preserving, collecting, reviewing, analyzing and producing information during civil legal actions. The goal of discovery is to obtain information that will be useful in developing relevant information for pre-trial motions and<br />
for the trial itself. Information sought during discovery can include documents, testimony and other information deemed necessary by a court.</p>
<p>E-discovery is simply the extension of the discovery process to information that is stored electronically and includes email, instant messages, word processing files, spreadsheets and other electronic content that may be stored on desktops, laptops, file servers, mainframes, smartphones, employees’ home computers or on a variety of other platforms.</p>
<p>E-discovery is becoming much more important in the context of civil litigation – for example, roughly three out of four discovery orders today require email to be produced as part of the discovery process. E-discovery today represents 35% of the total cost of<br />
litigation1, and companies that fail to produce emails in a timely or appropriate manner face the risk of paying millions of dollars in sanctions and fines, not to mention loss of corporate reputation, lost revenue and embarrassment.</p>

			<content:encoded><![CDATA[<p>During the first quarter, Akamai observed attack traffic originating from 125 unique countries around the world. China and the United States were the two largest attack traffic sources, accounting for some 30% of this traffic in total. Akamai observed attack traffic targeted at 23 unique network ports. Many of the ports that saw the highest levels of attack traffic were targeted by worms, viruses, and bots that spread across the Internet several years ago. A number of major network “events” occurred during the first quarter that impacted millions of Internet users. Cable cuts in the Mediterranean Sea severed Internet connectivity between the Middle East and Europe, drastically slowing communications. Cogent’s de-peering of Telia impacted Internet communications for selected Internet users in the United States and Europe for a two-week period. A routing change by Pakistan Telecom that spread across the Internet essentially took YouTube, a popular Internet video sharing site, offline for several hours.</p>
<p>Akamai observed that from a global perspective, South Korea had the highest measured levels of “high broadband” (&gt;5 Mbps) connectivity. In the United States, Delaware topped the list, with over 60% of connections to Akamai occurring at 5 Mbps or greater. At the other end of the bandwidth spectrum, Rwanda and the Solomon Islands topped the list of slowest countries, with 95% or more of the connections to Akamai from both countries occurring at below 256 Kbps. In the United States, Washington State and Virginia turned in the highest percentages of sub-256 Kbps connections. However, in contrast to the international measurements, these states only saw 21% and 18% of connections below 256 Kbps respectively.</p>

<p>Verdasys is a Leader due to balanced functionality and rich context-based analysis at the desktop. RSA Security stands out for its integrated vision and leading discovery capabilities, while Vericept rounds out the Leader class of 2008 because of its very balanced DLP coverage and strong analysis features.</p>
<p>The Strong Performer group is led by Workshare and Orchestria, both providing tight application integration at the desktop and a user-friendly approach to DLP. Code Green Networks is easy to use, cost-effective, and an ideal fit for small and medium-size businesses (SMBs). McAfee now offers strong integration with encryption and its popular ePolicy Orchestrator; Trend Micro has a strong international play featuring leading data-inuse protection.</p>
<p>Russia-based InfoWatch is a Contender and offers a straightforward DLP solution for many organizations in Eastern Europe and the Middle East. Ultimately, DLP will be a must-have that is integrated with security infrastructure; longer term, it will extend into information management.</p>
