The third annual Inside E-Discovery & Beyond Survey by BDO Consulting examines the opinions and insights of more than 100 senior in-house counsel at corporations with revenues ranging from $100 million to over $5 billion from a variety of industries throughout the United States about changes in their approaches to e-discovery and their plans for the year ahead. The survey was conducted by ALM, an independent and impartial research firm, in the fourth quarter of 2016.


The third annual Inside E-Discovery & Beyond Survey by BDO Consulting examines the opinions and insights of more than 100 senior in-house counsel at corporations with revenues ranging from $100 million to over $5 billion from a variety of industries throughout the United States about changes in their approaches to e-discovery and their plans for the year ahead. The survey was conducted by ALM, an independent and impartial research firm, in the fourth quarter of 2016.

Surveying senior in-house counsel at leading U.S. corporations, the survey offers insight into changes in organizations’ approaches to e-discovery amid an onslaught of new data pressures and predictions for the year ahead. Highlights include:

  • All about cyber. 68% state that their organization’s legal department is more involved with cybersecurity than it was 12 months ago.
  • Data privacy and e-discovery collide. 60% cite international data privacy and security laws as their biggest cross-border e-discovery challenge—and with the 2018 implementation data of the GDPR looming, 37% now see the EU as the most challenging jurisdiction for cross-border e-discovery.
  • 2017 spending plans. 62% plan to increase their investment in information governance in 2017–compared to only 39% last year, while 31% plan to increase their overall e-discovery spend.
  • Legal tech innovations are catching on. 40% of corporate counsel currently use technology-assisted review (TAR), while 30% use data analytics and visualization techniques across EDRMs.
