The March 25 verdict — finding that the platforms’ design was a substantial factor contributing to the depression, anxiety, and suicidal thoughts of a young woman who began using their products as a child — landed with the force of a legal earthquake, one whose aftershocks will reach deep into corporate compliance departments, litigation teams, and data governance offices across the technology sector.

The jury awarded the plaintiff, a 20-year-old California woman identified in court filings as K.G.M., a total of $6 million: $3 million in compensatory damages for therapy costs and lost future earnings, and an additional $3 million in punitive damages. Meta, the parent company of Instagram, was found 70 percent responsible, shouldering $2.1 million of the punitive award. Google, whose YouTube platform was the other defendant at trial, bore the remaining 30 percent, or $900,000 in punitive damages.

The dollar figure, while modest by Big Tech standards, is almost beside the point. What matters is the legal theory that got it there — and what it means for the over 2,400 pending actions in the consolidated multidistrict litigation known as MDL 3047.

A Defective Product, Not Defective Content

The trial’s outcome hinged on a strategy that legal observers have been watching closely since the litigation began: rather than arguing that harmful content on Instagram or YouTube caused K.G.M.’s injuries, her attorneys argued that the platforms themselves — their architecture, their design choices, their engineering — constituted defective products.

That distinction matters enormously. Section 230 of the Communications Decency Act has long shielded tech companies from liability over content posted by users. By reframing the case around product design rather than content moderation, lead attorney Mark Lanier and his team at The Lanier Law Firm sidestepped that shield entirely. The jury heard testimony about features like infinite scroll, autoplay video, algorithmic content recommendations, beauty filters, and push notifications — each presented not as neutral tools but as deliberate engineering choices designed to maximize engagement at the expense of user wellbeing.

“That’s called the engineering of addiction,” Lanier told the jury during the seven-week trial, according to NPR’s reporting on the proceedings.

K.G.M. testified that she began using YouTube at age 6 and Instagram at age 9. By her teens, she said, the platforms’ design had contributed to depression, body dysmorphia, and suicidal thoughts. Her attorneys showed the jury internal Meta documents in which CEO Mark Zuckerberg and other executives discussed strategies for attracting younger users. One internal document, as quoted by NPR from materials presented at trial, stated: “If we wanna win big with teens, we must bring them in as tweens.”

The jury’s finding that both companies acted with “malice, oppression, or fraud” — the legal standard required for punitive damages under California law — signals that jurors believed the companies knew their products were causing harm and continued the behavior anyway.

What the Verdict Means for Pending Litigation

This was a bellwether trial — widely described as the first social media addiction case to reach a jury anywhere in the country. While the federal MDL 3047, consolidated in the U.S. District Court for the Northern District of California under Judge Yvonne Gonzalez Rogers, has its own bellwether trials scheduled to begin June 15, 2026, as of this writing, the K.G.M. case was tried in Los Angeles County Superior Court. Its outcome served as the first real-world test of the defective-design theory that plaintiffs across the country intend to deploy.

The implications are hard to overstate. Over 2,400 actions — filed by individual plaintiffs, families, school districts, and Native American tribes — are pending in the federal MDL alone. If the defective-design framework holds up on appeal, it could reshape how courts evaluate technology companies’ liability for product architecture, a question that has vexed judges and legislators since social media became ubiquitous.

Both Meta and Google have announced plans to appeal. Google spokesperson Jose Castañeda said the company intends to challenge the verdict, calling YouTube “a responsibly built streaming platform, not a social media site,” according to reporting by CNBC. Meta has not detailed its appellate strategy but has signaled it will contest the verdict.

Notably, two other defendants in K.G.M.’s original complaint — Snapchat parent Snap Inc. and TikTok — settled before trial for undisclosed sums. Those settlements are not admissions of liability, but their timing suggests the companies preferred to resolve claims privately rather than face the same defective-design arguments in open court.

The eDiscovery and Compliance Angle

For cybersecurity, information governance, and eDiscovery professionals, this verdict carries operational consequences that extend well beyond the courtroom headlines.

First, the volume of internal documents surfaced during the trial — executive emails, product strategy memos, internal research on adolescent usage patterns — highlights the litigation exposure that poorly managed data retention policies create. Organizations tracking this case should audit their own document retention practices now, before similar discovery demands arrive. The Meta documents shown to the jury, including the “tweens” memo, became some of the trial’s most damaging evidence precisely because they survived long enough to be discoverable.

Second, the defective-design theory opens a new category of electronically stored information to discovery. Litigation teams should expect requests targeting product design documents, A/B testing results, engagement metrics, algorithmic tuning records, and internal communications about user behavior — a data set far broader than what traditional content-liability cases would generate. Information governance teams at technology companies and their outside counsel need to prepare collection and review protocols for these categories now.

Cybersecurity teams face their own set of challenges. Algorithmic recommendation systems, behavioral analytics pipelines, and engagement-optimization code are often classified as proprietary trade secrets. When those systems become targets of discovery, security professionals must balance disclosure obligations against intellectual property protection — a tension that will require close coordination between legal, engineering, and security departments. Protective orders and privilege reviews will need to account for the sensitivity of this data, and organizations should establish clear internal protocols before litigation forces the issue.

Third, the bellwether structure of MDL 3047 means that discovery rulings and document productions from this trial will influence hundreds of subsequent cases. Attorneys managing related litigation should study the evidentiary record here closely, as it will likely establish baseline expectations for what must be preserved and produced.

A Converging Regulatory Landscape

The broader regulatory environment adds urgency. The U.S. Surgeon General issued a formal advisory in 2023 warning that social media poses a “profound risk” to youth mental health, and in 2024 called for Congress to mandate warning labels on social media platforms. Multiple states — California, Utah, Texas, and others — have enacted or are advancing children’s online safety legislation, ranging from age verification mandates to design codes modeled on the United Kingdom’s Age Appropriate Design Code, which requires platforms to default to privacy-protective settings for minors and prohibits features that encourage excessive use.

The European Union’s Digital Services Act, fully in force since February 2024, already imposes design-accountability obligations on platforms with over 45 million EU users, including requirements to assess and mitigate systemic risks to minors and to offer users control over algorithmic recommendations. Noncompliance carries fines of up to 6 percent of global annual turnover. The KGM verdict gives domestic plaintiffs a jury-validated framework that runs parallel to the design-accountability principles regulators in Europe and at the state level are already pursuing.

The defective-design theory validated in this case is not limited to social media. Any organization operating a consumer-facing digital platform — whether in financial services, healthcare, education technology, or enterprise SaaS — that employs engagement-maximizing features like push notifications, infinite scroll, gamification loops, or algorithmic recommendations should evaluate its own design choices in light of this verdict. Compliance teams at these organizations should conduct product design audits now, mapping features that could trigger similar liability exposure and documenting the business justifications for those design decisions.

Both Sides Prepare for the Next Round

Lanier, a veteran Texas trial lawyer with 42 years of experience, told NBC News that this was the most difficult case he has ever tried. The seven-week trial required presenting complex technical evidence about algorithmic design to a lay jury — a challenge that future plaintiffs’ attorneys will need to replicate across dozens of upcoming bellwether cases.

For Meta and Google, the appeal will test whether the defective-design theory can survive appellate scrutiny. Defense attorneys are expected to argue that the theory stretches product liability doctrine beyond its intended scope, and that Section 230 should still apply to platform architecture decisions. How appellate courts rule on those questions will determine whether the KGM verdict becomes the template for thousands of cases — or an outlier.

Fortune magazine has already drawn the comparison to Big Tobacco litigation of the 1990s, when internal documents revealing that cigarette manufacturers knew their products were addictive helped transform individual lawsuits into an industry-wide reckoning. Whether social media litigation follows the same trajectory depends on what happens next: in appellate courts, in the remaining bellwether trials, and in corporate boardrooms where executives must now weigh the cost of addictive design against the cost of defending it.
